PLEASE READ THIS END-USER LICENSE AGREEMENT ("AGREEMENT") CAREFULLY BEFORE USING LOOKAWAY ("APP"). BY USING THE APP, YOU ARE AGREEING TO BE BOUND BY THE TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT, DO NOT USE THE APP AND PROMPTLY DELETE IT FROM YOUR DEVICE.

License Grant

Subject to the terms and conditions of this Agreement, Mystical Bits, LLC grants you a limited, non-exclusive, non-transferable license to use the App on a designated number of Mac computers for personal or commercial use. Licenses are available for 1 Mac, 2 Macs, and 5 Macs with options to purchase additional licenses as needed.

Purchase and Activation

• License Key: In order to use the App, you must purchase a valid license key from Mystical Bits, LLC or an authorized reseller. The license key is unique to you and must not be shared or resold.

• Acceptance: By purchasing the license key and activating the App, you acknowledge that you have read, understood, and agreed to be bound by the terms and conditions of this EULA.

Ownership

The Licensor retains all right, title, and interest in and to the App, including all intellectual property rights. This Agreement does not convey to you any ownership rights or interest in the App, except for the limited license granted herein.

Updates

During the one-year period following your purchase of the license key, you are entitled to receive free updates to the App. Mystical Bits, LLC reserves the right to charge for additional features beyond the one-year period.

Use Restrictions

• Device Use: The license key and the App may only be used on the designated number of computers at a time. However, you are permitted to move the license key to a different computer, provided that you deactivate the App on the original computer before activating it on the new computer.

• Prohibited Actions: You shall not:

  • Reverse engineer, decompile, or disassemble the App, except and only to the extent expressly permitted by applicable law.
  • Modify, adapt, or create derivative works of the App.
  • Remove, alter, or obscure any copyright, trademark, or other proprietary notices contained in the App.
  • Use the App in any manner that violates applicable laws or regulations.
  • Share, distribute, resell, sublicense, or transfer the license key or the App to any third party.

Warranty Disclaimer

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MYSTICAL BITS, LLC DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MYSTICAL BITS, LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE USE OR PERFORMANCE OF THE APP, EVEN IF MYSTICAL BITS, LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Termination

This Agreement is effective until terminated. Your rights under this Agreement will terminate automatically without notice if you fail to comply with any term or condition of this Agreement. Upon termination, you shall cease all use of the App and destroy all copies of the App in your possession or control.

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the United States. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of the United States.

Entire Agreement

This Agreement constitutes the entire agreement between you and Mystical Bits, LLC with respect to the subject matter hereof and supersedes all prior or contemporaneous understandings or agreements, whether written or oral.
